§ 12-14. Purpose and scope.

  • (a)

    This article is intended to supplement Chapter 552, Florida Statutes, as amended, and Chapter 69A-2, Florida Administrative Code, as amended, and not to supersede or conflict with provisions thereof. The intent and purpose of this article is hereby declared to provide more stringent regulations and control of explosives in the County, for the public safety, health, and welfare, and to prevent the possession and use of explosives by unauthorized persons.

    (b)

    The provisions of this article shall apply in all areas of Broward County, inclusive of the various municipalities, unless the provisions of this article are in conflict with an ordinance of a municipality; in which case this article shall not be effective within the municipality to the extent of such conflict, regardless of whether such municipal ordinance was adopted or enacted before or after the County ordinance.

    (c)

    For purposes of enforcing this article against persons holding Broward County blasting and storage permits and licenses, the existence of conflicts between this article and any municipal blasting, explosives, and blasting agents ordinance(s) shall be determined by the Broward County Permitting, Licensing and Consumer Protection Division, or successor agency (hereinafter referred to as "Division"), after having reviewed the applicable ordinance(s) and having consulted with municipal representatives. Prior to enforcing this article within municipal limits against permit applicants and license holders, the Division shall ensure that persons blasting, using, transporting, handling, or storing explosives and blasting agents within municipal limits have received notice of the Division's conflict determination(s) and the provisions of this ordinance which are effective within the municipality. Notice shall be provided by hand delivery or U.S. registered mail, return receipt requested, at the address listed on the blasting or storage permit or license application.

    (d)

    This article shall apply to the use, handling, transportation, and storage of explosives and blasting agents. Application for licenses required herein shall be made to the director of the Division, or designee. Explosives and blasting agents shall not be used, handled, or stored within Broward County unless a blasting and/or storage permit has been issued by the Division .

    (e)

    The Division shall review and permit all approved applications for the use, handling, storage, and blasting of explosives and blasting agents within Broward County.
