  § 1-89. Cultural council—Trust account.

  • (a)

    Established. There is hereby created a Broward Cultural Council trust account within the general trust fund for the purposes of accepting and disbursing gifts, grants, and awards of money or property made to Broward County for the use and benefit of the Broward Cultural Council.

    (b)

    Term of existence. The Broward Cultural Council trust account within the general trust fund shall be self-perpetuating and sustaining from year to year unless specifically terminated by the Board of County Commissioners.

    (c)

    Trust assets.

    (1)

    All gifts, grants, and awards of money or property received hereunder from either public or private donors shall be placed in trust for and inure to the use and benefit of the Broward Cultural Council, its successors and assigns in interest; and said property and funds shall be expended, utilized, and disbursed only for the operation, expansion, and improvement of the Broward Cultural Council.

    (2)

    Funds shall be appropriated (budgeted) and expended in accordance with established Board policies and procedures.

    (d)

    Monetary Gifts, etc.

    (1)

    All gifts, grants, and awards of moneys hereunder shall be deposited in the Broward Cultural Council Trust Fund Account within the general trust fund.

    (2)

    Moneys obtained hereunder may be accepted on behalf of Broward County by the Director of the Cultural Division or such other person or persons as may be designated by resolution of the Board of County Commissioners and upon receipt of said moneys shall cause the same to be delivered to the Broward County Records, Taxes, and Treasury Division, which shall cause the same to be credited to the Broward Cultural Council Trust Fund Account or allocated as the terms of the grant may require.

    (3)

    Funds deposited or credited to the Broward Cultural Council Trust Fund Account not expended by the close of any fiscal year shall be carried forward into the next succeeding fiscal year.

    (e)

    Rights and Interest to Property.

    (1)

    All gifts, grants, and awards of either real or personal property hereunder may be accepted on behalf of Broward County by the director of the Cultural Division or such other person or persons as may be designated by resolution of the Board of County Commissioners.

    (2)

    The title to all property accepted hereunder shall repose and be vested in Broward County, Florida, for the use and benefit of the Broward Cultural Council, its successors and assigns in interest.

    (3)

    No real property or any appurtenances or fixtures thereto shall be accepted hereunder unless acceptance thereof is authorized by the Board of County Commissioners.

    (f)

    Rules and Regulations.

    (1)

    The county administrator may promulgate and establish such rules and regulations as may be necessary to give effect to the intent and purpose of this section.

    (2)

    Any rules or regulations established hereunder shall be included in the Broward County Administrative Code.
