§ 1-533. Donations.

  • (1)

    All gifts and awards of money hereunder shall be deposited in the trust fund, which shall be a separate account established and maintained apart from the general revenue fund and accounts of Broward County.

    (2)

    All gifts and awards of money received hereunder from either public or private donors shall be delivered to the Broward County Finance and Administrative Services Department, which shall cause same to be credited to the trust fund.

    (3)

    Pursuant to Section 18.63 of the Broward County Administrative Code, donations obtained hereunder of five hundred dollars ($500.00) or less may be accepted by the county administrator or his or her designee. Donations of more than five hundred dollars ($500.00) may be accepted only by the board of county commissioners.

    (4)

    The title to all property accepted hereunder shall repose and be vested in Broward County, in trust; however, for the use and benefit of the Homeless Board, its successors and assigns, only for purposes of homeless initiatives, activities, programs, and projects.

    (5)

    No real property, or any appurtenances or fixtures thereto, shall be accepted unless authorized by the board of county commissioners.

    (6)

    In the event that the Homeless Initiative Partnership Advisory Board is abolished, all property and cash in the Trust Fund shall be distributed to one or more organizations described in Section 501(c)(3) of the Internal Revenue Code which provide services to the homeless. The county commission shall determine which organization(s) shall receive trust fund property.
