§ 20-169. Powers of the consumer protection board.

  • The functions, powers and authority of the consumer protection board shall include but not be limited to the following:

    (a)

    To issue and enforce cease and desist orders which enjoin the commission or perpetration of unfair methods of competition and unfair or deceptive trade acts or practices in the conduct of any business, trade or commerce;

    (b)

    Hold hearings, conduct investigations, provide for the administration of oaths and take testimony under oath in all matters relating to consumer protection;

    (c)

    Advise the board of county commissioners, and the director on pertinent issues relating to consumer legislation and enforcement practices;

    (d)

    Revoke or suspend occupational licenses, subject to approval by resolution of the board of county commissioners;

    (e)

    Issue written advisory opinions upon request, with rationale relative to methods of competition, commercial transactions, and trade acts and practices in the conduct of any business, trade or commerce;

    (f)

    Subpoena persons and evidence for the purpose of discovery in a pending action; and subpoena evidence, alleged violators and witnesses to its hearings; upon the written request of any party. A subpoena may be served by any person authorized by law to serve process. Service shall be made as provided by law. Any person subject to a subpoena may, before compliance and on timely petition, request a three-member hearing board to invalidate the subpoena. A party may seek enforcement of a subpoena issued under the authority of this section by filing a petition for enforcement in the county court. Failure to comply with an order of the court may result in a finding of contempt of court. However, no person shall be in contempt while a subpoena is being challenged. Witness fees shall be paid as provided by law;

    (g)

    Exercise and perform such other and further powers, duties and authority as may be provided in the Broward County Administrative Code.
