§ 20-176.123. Certain drug, prostitution, and criminal street gang-related activities declared public nuisances.

  • The Board of County Commissioners of Broward County hereby declares that any place or premises that is used as follows may be declared a public nuisance, and such nuisance may be abated pursuant to the procedures provided herein:

    (1)

    On more than two (2) occasions within a six (6) month period, as the site of a violation of Section 796.07, Florida Statutes, as may be amended from time to time;

    (2)

    On more than two (2) occasions within a six (6) month period, as the site of an unlawful sale, delivery, manufacture, or cultivation of any controlled substance;

    (3)

    On one (1) occasion as the site of the unlawful possession of a controlled substance, where such possession constitutes a felony, and that has also been used on more than one (1) occasion within the previous year as the site of the unlawful sale, delivery, manufacture, or cultivation of any controlled substance;

    (4)

    By a criminal street gang for the purpose of conducting a pattern of criminal street gang activity, as defined by Section 874.03, Florida Statutes, as may be amended from time to time; or

    (5)

    On more than two (2) occasions within a six (6) month period, as the site of a violation of Section 812.019, Florida Statutes, as may be amended from time to time, relating to dealing in stolen property.
