§ 20-511. Removal of wiring or equipment upon termination of services.
(a)
Upon termination of service to any subscriber, the Operator shall promptly remove all portions of its system, facilities and equipment from the subscriber's premises upon his or her request. Where removal is impractical, such as with buried cable or internal wiring, facilities and equipment may be disconnected rather than removed.
(b)
Upon voluntary termination of service by a subscriber, an OVS Operator shall not remove the home wiring unless it first gives the subscriber the opportunity to acquire the wiring. If the subscriber desires to purchase the wiring, the cost shall be determined as the replacement cost less depreciation. The cost is to be determined based on the cost per foot of the cabling multiplied by the length in feet of the home wiring. If the subscriber declines to acquire the home wiring, the Operator must then remove it within thirty (30) days at no cost to the subscriber or make no subsequent attempt to remove it or to restrict its use. This provision does not apply where the home wiring belongs to the subscriber, such as where the Operator has transferred ownership to the subscriber, the Operator has been treating the wiring as belonging to the subscriber for tax purposes, or the wiring is considered to be a fixture by state or local law in the subscriber's jurisdiction. Nothing in this subpart shall affect the Operator's rights and responsibilities to prevent excessive signal leakage while providing service, or the Operator's right to access the subscriber's property or premises.
