§ 20-541. Continuity of service.

  • (a)

    It is the right of a subscriber to receive all available services from the Operator as long as the subscriber satisfies its obligations under the use agreement with the Operator. It is a violation of this article for the Operator to terminate service or fail to provide service to its system for more than forty-eight (48) consecutive hours. This section does not apply to acts of God or acts of war.

    (b)

    In the event of a termination or transfer of a use agreement for whatever reason, the Operator must do everything in its power to ensure that all County subscribers receive continuous uninterrupted service regardless of the circumstance. If necessary, to ensure continuity of service, the Operator must cooperate with the County to operate the system for a temporary period not to exceed six (6) months. Revenues accrued during that period of time shall be received by the Operator.
