§ 27-283. Definitions.

  • When used in this article, the following words, phrases and terms shall have the indicated meanings unless the context clearly indicates otherwise:

    Agricultural burning is the burning of vegetative material originating onsite in conjunction with the cultivation of land, and including: gardening or horticulture, fruit growing, raising of vegetables, trees, shrubs, plants, or pastureland.

    Air curtain incinerator is a portable or stationary combustion device that directs a plane of high-velocity forced draft air through a manifold head into a pit with vertical walls in such a manner as to maintain a curtain of air over the surface of the pit and a recirculating motion of air under the curtain. An air curtain incinerator is considered open burning for purposes of this article.

    Air pollution is the presence in the outdoor atmosphere of the County of any one (1) or more substances or pollutants in quantities which are or may be potentially harmful or injurious to human health or welfare, animal or plant life, or property, or which unreasonably interfere with the enjoyment of life or property, including outdoor recreation.

    Air pollution episode is any day on which generally unhealthy air (an Air Quality Index value of 151 or greater) occurs or is forecast to occur by the Environmental Protection and Growth Management Department ("EPGMD") or the U.S. Environmental Protection Agency.

    Excessive visible emissions are air pollutants emitted in such quantity as to exceed a Florida Department of Environmental Protection opacity standard as determined by a visible emissions observer certified pursuant to Section 62-297.320, F.A.C., or reduce any observer's view to less than one hundred (100) feet.

    Extinguished means the absence of any visible flames, smoke, or emissions.

    Forced draft is an adequate current of air blown or forced by a fan or other mechanical means which is directed or arranged in relation to the open burning in such a manner as to increase the temperature of the fire and to reduce or minimize the resultant possibility of air pollution.

    Garbage means all kitchen and table food waste, animal or vegetative waste that is attendant with or results from the storage, packaging, preparation, cooking, or handling of food materials.

    National Weather Service air stagnation advisory is an advisory issued by the National Weather Service to caution local and regional agencies on meteorological conditions that are expected to persist for at least thirty-six (36) hours, which are conducive to poor dispersion.

    Nuisance means any open burning activity which is potentially harmful or injurious to human health or property or which is annoying or offensive to building occupants or residents.

    Occupied building is any building that serves as a primary residence, meeting place, or place of business.

    Opacity means a condition which renders material partially or wholly impervious to rays of light, causing obstruction of the observer's view.

    Open burning means the burning of material in such a manner that the products of combustion resulting from the burning are emitted directly into the outdoor atmosphere without passing through a stack or chimney.

    Pile burning is any burning of silvicultural or agricultural debris originating on a site and that has been stacked together in a round or linear (windrow) fashion.

    Prescribed burning is the controlled application of fire to naturally occurring vegetation under specified environmental conditions, and following appropriate precautionary measures, which causes the fire to be confined to a predetermined area and accomplishes planned land management objectives.

    Silvicultural burning is prescribed burning in accordance with that phase of forestry that deals with the establishment, development, reproduction, and care of forest fauna and flora.

    Startup is the commencement of operations of any air curtain incinerator which has shut down or ceased operations for a period of time.

    Sunset is the official time the sun will set as set forth by the U.S. Naval Observatory (tables are available at the National Weather Services offices or website).

    Trash means construction or demolition debris, and other debris such as paper, cardboard, cloth, glass, street sweepings, vehicle tires, and other like matter.

    Vegetative debris includes yard trash and vegetative waste generated by natural disasters, including hurricanes and tornadoes.

    Waste pesticide containers means any containers made of combustible materials, including but not limited to paper, plastic, or burlap, which formerly contained pesticides and which the manufacturer or formulator provided as an end user conveyance for the specified product.

    Yard trash means vegetative matter resulting from landscaping and yard maintenance operations and includes materials such as tree and shrub trimmings, grass clippings, palm fronds, trees, and tree stumps.
