§ 27-285. Open burning allowed.
The following open burning activities are allowed:
(a)
Municipal, industrial, commercial, and research open burning.
(1)
Open burning in connection with industrial, commercial, or municipal operations is prohibited, except when the open burning is determined by the EPGMD to be the only feasible method of operation and prior notification is provided to the EPGMD.
(2)
Opening burning in connection with an emergency which requires immediate action to protect human health and safety.
(3)
Open burning in connection with county or municipal operations to burn hurricane, tornado, fire, or other disaster-generated vegetative debris using an air curtain incinerator. The operation of air curtain incinerators to burn vegetative debris generated by a natural disaster shall be subject to the same limitations for air curtain incinerators in subsection 27-286(b).
(4)
Open burning which is essential to a research project is allowed provided prior notification is provided to the EPGMD and measures are taken to protect ambient air quality from pollutants and contaminants to the greatest extent feasible.
(b)
Miscellaneous open burning. A campfire, bonfire, or other fire will be allowed, that is used solely for recreational purposes, for ceremonial occasions, or for outdoor noncommercial preparation of food, as long as excessive smoke and a nuisance are not created. Where required, approval must be obtained from the appropriate fire authority.
(c)
Open burning for the training of firefighters. Open burning for the purpose of training firefighters will be allowed, subject to the requirements in Subsection 27-286(c).
(d)
Agricultural and silvicultural fires. Open burning will be allowed for agricultural and silvicultural fires when approved by the Florida Division of Forestry.
