§ 27-306. License and operating requirements.
(a)
General requirements. Sections 27-306 through 27-322 identify the criteria under which a storage tank facility license is required, application contents, general conditions and operating requirements for all activities regulated under this article.
(b)
Storage tank facility license.
(1)
License required: A storage tank facility license shall be required to build, erect, operate, modify, maintain out-of-service status, close or replace in whole or in part any storage tank system that is intended to store hazardous material unless otherwise exempted by the code. This provision does not apply to routine maintenance procedures. Certified contractors, that are required to perform construction activities in accordance with section 27-302(a)(11), shall apply to EPGMD on EPGMD application forms and obtain a license approval. The responsibilities of the Certified Contractor under such approval shall be limited to the scope of construction activity referenced in the application and shall cease upon the issuance of the operational approval by EPGMD to the owner.
(2)
Application for license: Application for a license shall be submitted on EPGMD forms and shall provide all information as requested therein.
(3)
Modification of a license: Prior to the modification activity, an owner or operator seeking to alter or change EPGMD-approved design, operation, and maintenance or closure/post-closure design of a facility, or installation or upgrading to meet the requirements of section 27-307, including any conditions imposed in the license or license modification, shall apply to EPGMD for approval to modify the license in accordance with EPGMD policy. Certified contractors, that are required to perform construction activities in accordance with section 27-302(a)(11), shall apply to EPGMD and obtain approval to modify the storage tank facility in accordance with section 27-306(b)(1). Acts including, but not limited to, the following constitute modifications to which this section applies:
a.
The replacement of underground or aboveground pipes;
b.
The installation, replacement, closure, or repair of any storage tank system, including secondary containment, spill containment, dispenser liner, piping sump;
c.
The addition of any storage tank(s) or dispensing islands to an existing storage tank facility;
d.
The installation of vapor recovery piping or Stage II type system change;
e.
The field installation or replacement of cathodic protection; and
f.
The decommissioning of the Stage II vapor recovery systems.
(4)
License fees: License fees as established by resolution shall accompany the license application.
(5)
License display: The license shall be displayed in plain view in the office, kiosk or suitable location at the facility where the tanks are located.
(6)
General conditions: The owner/operator shall comply with all of the general conditions specified in section 27-58, Broward County Code.
(c)
Construction and operation requirements. The construction and operation of a storage tank facility shall be in accordance with the applicable provisions of the Broward County Local Amendments to the Florida Fire Prevention Code, the Florida Building Code, the most current version of Chapters 62-252, 62-761, and 62-762, F.A.C., this article, and the code. A storage tank operating approval shall be issued to the owner/operator who has met all the requirements set forth in the construction modification approval/license. This operational approval shall be issued to the owner after the engineer's "as-built" or "record" construction drawings and associated storage tank system tests have been received and reviewed by EPGMD to confirm compliance with the code. The engineer's as-built or record drawings shall be signed and sealed by a professional engineer registered in the State of Florida.
