§ 2-2. Definitions.

  • For the purpose of this Chapter 2, the following terms, phrases, words, and their derivations shall have the meanings given herein when not inconsistent with the text, unless otherwise specifically defined, or the context of their usage clearly indicates another meaning. The word "shall" is mandatory, and the word "may" is permissive. Words relating to aeronautical practices, processes, and equipment shall be construed according to their usage in the aviation industry.

    (a)

    Abandon shall refer to tangible personal property which does not have an identifiable owner and which has been disposed of on Airport property, whether the property is operative or inoperative.

    (b)

    Aircraft shall mean any contrivance now known or hereafter designed, invented, or used for navigation or flight in the air or space, except a parachute or other contrivance designed for air navigation, but used primarily as safety equipment.

    (c)

    Airport shall mean the Fort Lauderdale-Hollywood International Airport ("FLL") or North Perry Airport ("HWO"), and any other airport facility owned, leased, operated, or otherwise under the management of the County now existing or that may hereafter be developed.

    (d)

    Airport Fueling Program shall mean that program developed by the Department to permit authorized aircraft or ground service equipment fueling operations on the AOA, and the training of personnel who conduct aircraft or ground service equipment fueling on the AOA.

    (e)

    Airport Issued Identification Media shall mean the security identification badge issued by the Department that serves as the officially recognized security identification at FLL.

    (f)

    Airport Operations Area, Air Operations Areas, or AOA shall mean any portion of the Airport used for landing, taking off, or surface maneuvering of aircraft, and surrounding airside areas.

    (g)

    Apron or Ramp shall mean that area of the Airport designated by the Aviation Director for the loading, unloading, servicing, and parking of aircraft.

    (h)

    Authorized shall mean acting under or pursuant to a written contract, lease, permit, authorization, agreement, or other written document approved and executed by the County or the Director of Aviation, or other duly authorized County employee.

    (i)

    Aviation Director or Director shall mean the Director of the Aviation Department, or his or her duly authorized designee.

    (j)

    Board shall mean the Board of County Commissioners of Broward County, Florida.

    (k)

    Code shall mean the Code of Ordinances of Broward County, Florida, as it may be amended from time to time.

    (l)

    Commercial Activity shall mean the exchange, trading, buying, hiring, or selling of commodities, goods, services, or property of any kind, or any revenue- producing activity conducted on the Airport.

    (m)

    Control Tower shall mean a Federal Aviation Administration (FAA) Air Traffic Control Tower, or FAA contract control tower, located at the Airport or one which may be operated on behalf of the Airport.

    (n)

    County shall mean Broward County, a political subdivision of the state of Florida.

    (o)

    Curbside shall mean the curb and any lanes designated for loading and unloading of passengers, luggage, or cargo at the Airport.

    (p)

    Department or Aviation Department shall mean the Broward County Aviation Department, or any successor entity.

    (q)

    Escort shall mean to accompany or supervise an individual who does not have unescorted access authority to areas restricted for security purposes, as defined in the Airport Security Program, in a manner sufficient to take action should the individual engage in activities other than those for which the escorted access is granted. An escort shall have a person or vehicle that is granted unescorted access to areas restricted for security or operational purposes under constant surveillance and control in a manner that permits corrective action to be taken should the person or vehicle operator engage in activities other than those for which the escorted access was granted.

    (r)

    Federal Aviation Administration or FAA shall mean the administrative agency of the Department of Transportation authorized to regulate aeronautical activities, or any successor agency.

    (s)

    Federal Aviation Regulations or FAR shall mean the regulations promulgated by the Federal Aviation Administration to regulate aeronautical activities.

    (t)

    Ground Transportation Area shall mean the restricted use lanes located along various portions of the passenger terminal roadway system.

    (u)

    Motor vehicle or vehicle shall mean a device in, upon, or by which a person or property may be propelled, moved, or drawn upon land or water, except a device moved by human or animal power. This definition does not include aircraft, trains, or devices moved exclusively upon stationary rails or tracks.

    (v)

    Movement Area shall mean the runways, taxiways, and other areas of the Airport under the control of the Control Tower which are used for taxiing, takeoff, and landing of aircraft, exclusive of aprons and ramps.

    (w)

    NFPA shall mean the National Fire Protection Association.

    (x)

    Nonmovement Area shall mean those portions of the Airport designed for the surface maneuvering of aircraft not under the control of the Control Tower.

    (y)

    Operator shall mean any person who is in actual physical control of an aircraft or motor vehicle.

    (z)

    Park shall mean to put, leave, or allow a vehicle or aircraft to stand or stop in any location whether the operator thereof leaves or remains in such vehicle or aircraft, when such standing or stopping is not required by traffic controls or conditions beyond the control of the operator of the vehicle or aircraft.

    (aa)

    Permittee shall mean any person authorized by license, lease, or other written agreement to be at or on the Airport.

    (bb)

    Person shall mean any individual, firm, partnership, corporation, company, association, joint stock association, or body politic; and includes any trustee, receiver, committee, assignee, or other representative or employee thereof.

    (cc)

    Ramp Control shall mean the entity responsible for controlling the surface movement of Aircraft on those portions of the Airport designated by the Department.

    (dd)

    Restricted Area shall mean any area of the Airport that prohibits entry or limits entry or access to specific authorized persons or vehicles.

    (ee)

    Security Identification Display Area (SIDA) shall mean the areas identified in the Airport Security Program requiring each person to continuously display on his or her outermost garment, above the waist, an Airport-Issued Identification Media, unless under Airport-approved escort.

    (ff)

    Security Program or Airport Security Program shall mean that program developed by the Department pursuant to the requirements of the federal regulations relative to the protection and safety of aircraft operations and users of the Airport.

    (gg)

    Terminal Complex shall mean the passenger terminal facilities or associated airport facilities, at the Fort Lauderdale-Hollywood International Airport, including loading bridges, aircraft parking apron, landside facilities, and all roadways and parking facilities associated therewith, including any expansion or improvements thereto serving the passenger terminals.

    (hh)

    Transportation Security Administration or TSA, or any successor agency, shall mean the entity appointed by the United States Department of Transportation to be responsible for airport security and the inspecting of persons and property carried by aircraft operators and foreign air carriers.

    (ii)

    Vehicle Ramp Access Decal Program shall mean that program developed by the Department to permit motor vehicle access on the AOA.

    (jj)

    Weapon shall mean a gun, knife, blackjack, slingshot, metal knuckles, or any explosive device, or any other similar instrument capable of being utilized to coerce, intimidate, or injure a person or property.
