§ 2-6. Issuance of alcoholic beverage license to governmental agency at Fort Lauderdale-Hollywood International Airport.
An alcoholic beverage license was issued to the County pursuant to Special Act, Chapter 75-344, which shall be utilized as follows:
(a)
One license as provided in § 561.17, F.S. shall be issued to the County, or any other governmental agency which may, in the future, operate the Fort Lauderdale-Hollywood International Airport.
(b)
The license shall be issued upon written or printed application therefor made to the Division of Alcoholic Beverages and Tobacco of the Department of Business and Professional Regulation (Division), stating the character of the business to be engaged in, the address of the building wherein the business sought to be licensed is or will be located, and the kind of license as defined in Chapter 561, F.S. that the applicant desires. The application shall be in the name of either the County, or such other governmental agency operating the airport, or its lessee, subject to retransfer as set out in subsection (c) hereof. The applicant shall pay to the Division the license fee for the type of license that the applicant desires as provided in § 565.02, F.S.
(c)
The license shall be for the term and subject to renewal as provided in §§ 561.26, 561.27, F.S. Any business operated under such license shall be operated only by a lessee of County. County and lessee shall make application for the transfer of the license and the application shall be approved by the Division by the procedures provided in §§ 561.18, 561.19, F.S.; provided, however, that any transfer or issuance of the license to the lessee shall be conditioned on the immediate retransfer of the license to the County upon termination at any time and for any cause of the lease between County and lessee. In the event of the failure and refusal of the lessee to retransfer the license, it shall be retransferred to the County, or such other governmental agency operating the Airport, upon County's request, in writing, to the Division. Thereafter, the license may be again transferred to any new lessee of the County upon the same terms and conditions.
(d)
It is the intent and purpose of this section that the license shall at all times be and remain the property of the County, or such other governmental agency operating the Airport, subject to its transfer from time to time to enable the lessee of the County to operate under the license authorized by Special Act 75-344.
