§ 3½-10. Powers and duties of EMS review committee.

  • (a)

    The review committee shall have the power to hold hearings, conduct investigations and take testimony in all matters relating to violations of this chapter or any rules promulgated hereunder by any EMS provider operating in Broward County other than violations by any BLS transport provider.

    (b)

    The review committee may recommend to the board of county commissioners that a certificate of public convenience and necessity or a license be revoked, modified or suspended where it is found that:

    (1)

    The certificate holder or licensee has failed or neglected to render services as required by the certificate or license, this chapter, the rules and regulations promulgated by the county administrator or Florida statute;

    (2)

    The application by which the certificate or license was secured from the board of county commissioners contains false representation or omitted material facts;

    (3)

    The certificate holder, the licensee or its agent has demanded money or other compensation in excess of that established in the schedule of fees filed with the board of county commissioners pursuant to this chapter;

    (4)

    The certificate holder has not served the public convenience and necessity.

    (c)

    The EMS review committee shall not hear violations of this chapter, any rules promulgated hereunder, or pursuant to any agreement entered into between the county and any BLS transport provider. Such violations shall be heard by a hearing officer as set forth within section 3½-14.
