Article VII. LOCAL GOVERNMENT INFRASTRUCTURE SURTAX |
§ 31½-114. Use and oversight of infrastructure surtax proceeds.
(a)
Infrastructure Surtax proceeds shall be collected, allocated, disbursed, and expended for authorized infrastructure purposes, in accordance with Sections 212.054 and 212.055(2)(d), Florida Statutes, the Transportation System and Infrastructure Surtaxes Interlocal Agreement between Broward County and Broward municipalities ("ILA"), and the Ballot Measure. A copy of the ILA shall be kept on file and available for inspection during regular business hours in the Broward County Office of Management and Budget.
(b)
Surtax Oversight Board. To ensure accountability, objectivity, and transparency in the distribution and expenditure of Infrastructure Surtax proceeds, the ILA establishes an independent Transportation and Infrastructure Surtax Oversight Board ("Oversight Board") to review and approve proposed infrastructure projects funded, in whole or part, with Infrastructure Surtax proceeds, for consistency with the requirements of Section 212.055(2), Florida Statutes, and the ILA. The members of the Oversight Board shall be appointed, serve, and carry out their responsibilities as provided in the ILA and herein. Infrastructure projects shall be funded with Infrastructure Surtax proceeds only as approved by the Surtax Oversight Board.
