§ 31-48. Declaration of legislative intent.

  • (a)

    It is hereby declared to be the purpose and intent of the board of county commissioners of Broward County, Florida, to require in the unincorporated area of Broward County, except as is hereinafter provided, that not more than twenty (20) per cent of the swale area of the public right-of-way, being that area immediately adjacent to the paved road surface and extending to the right-of-way line or to the edge of the sidewalk, not be paved with any type of impervious material or any type of lime rock or stabilizing materials.

    (b)

    More than twenty (20) per cent of said swale area may be paved by the abutting property owner upon the issuance of a permit by the director of the Broward County Water Management Division, which permit shall be conditioned upon the property owner providing and maintaining additional subsurface drainage facilities in accordance with standards of the Broward County Water Management Division as hereinafter set forth in sections 31-49 and 31-50.
