§ 5-66. Uncontested notice of violation.

  • (a)

    If no objections to a notice of violation and order to show cause are filed within thirty (30) days of the date of service, the director may apply to the Board for a final order requiring that corrective action be taken in order to comply with the notice of violation and order to show cause.

    (b)

    Upon application of the director under Subsection (a) of this section, a hearing shall be set before the Board and the director may present evidence in support of the notice of violation and order to show cause. If the Board is satisfied that the evidence presented is sufficient to substantiate the notice and order, the Board may issue an order as provided in Subsection 5-65(n) of this article.
