§ 9-13. Maintenance of qualifications.

  • (a)

    All individuals and business organizations certified pursuant to this chapter shall have the duty and obligation to inform the board in writing of any change in business or legal status, place of business address, mailing address or telephone number. The certified individual or business organization shall be responsible for retaining proof that the board has been notified of any change of address.

    (b)

    If any individual qualifying a business organization ceases to be affiliated with such business, the qualifying agent shall inform the board, as provided in Section 9-20 of this chapter. In addition, if such individual is the only certified individual qualifying the business organization, the business organization shall notify the board in writing within five (5) days of the individual's termination of affiliation. The business organization may not engage in contracting until such time as a qualifying agent is approved by the board. If an incomplete contract exists at the time a qualifier ceases to be affiliated with the business organization, the business organization shall notify the board within thirty (30) days of the name and address of the individual who has knowledge of the contract and ability to complete it. With the approval of the board, such an individual may complete the contract. For the purposes of this section, an incomplete contract is one which has been awarded to, or entered into by, the qualifier before the qualifier ceased to be affiliated with the business organization, regardless of whether any actual work has commenced.

    (c)

    Except as otherwise provided in this section, any business organization certified pursuant to this chapter that fails at any time to have a qualifying agent or which fails to maintain any of the standards or qualifications for certification shall automatically become "inactive" without any action being taken by the board.

    (d)

    Whenever a certificate holder or business organization fails to maintain any of the qualifications or standards required for certification, such certificate holder or business organization shall report such lack of qualifications to the board, as provided in Section 9-20 of this chapter, whereupon the board may, after notice and hearing, suspend or revoke the certificate of competency or certificate of authority or order such other disciplinary action as the board deems just and proper.

    (e)

    The board may, for good cause, review the qualifications of any individual or business organization prior to renewal of certification. If the individual or business organization fails to meet the board's qualifications for certification, the board may refuse to renew the certification.
