§ 9-23. Advertising.

  • (a)

    Prohibition. All individuals and business organizations required to be certified under the provisions of this chapter and who have not been issued a current active certificate by the board shall not advertise in any newspaper, airwave transmission, classified telephone directory, sign, or other advertising medium accessible to the public within Broward County that such individual is a contractor, subcontractor, specialty contractor, or that such individual is qualified to engage in any trade or occupation regulated by this chapter, nor shall such individual or business organization represent or act as being qualified or authorized to do business in any trade or occupation regulated by this chapter.

    (b)

    Any individual or business organization which conducts any business in Broward County for which a certificate of competency or State registration is required shall have prominently displayed on each side of each vehicle used to conduct business within Broward County the following information, in bold letters and numerals, at least one and one-half (1½) inches high, distinctly contrasting in color with the background, and affixed to the vehicle in such a manner so as to be readily distinguishable from a distance of not less than ten (10) meters (32.8 feet):

    (1)

    The trade name, symbol, or "logo" of the individual or business organization utilizing the vehicle for commercial or business purposes;

    (2)

    The general nature or character of the business, if the trade name or symbol does not describe the general nature of the business;

    (3)

    The street address and telephone number of the business organization; and

    (4)

    The individual's or qualifying agent's certificate of competency number issued by the board.

    (c)

    If an individual is utilizing a private motor vehicle in conducting business on behalf of someone else or a business organization and the motor vehicle does not comply with subsection (b) above, the display shall state:

    (1)

    "Employed by" and the trade name, symbol, or logo of the individual or business organization for which the individual is conducting business;

    (2)

    The general nature of the business, if the trade name or symbol does not describe the general nature of the business;

    (3)

    The street address of the business organization and telephone number of the qualifying agent of the business organization; and

    (4)

    The qualifying agent's certificate of competency number issued by the board.

    (d)

    Employees of individuals or business organizations who use their private motor vehicles at single-family or multi-family residential job sites when performing construction, service, or maintenance work covered by this chapter, where there is no building permit required for the work, shall comply with the vehicle display requirements set forth within subsection (b) above on their private motor vehicles.

    (e)

    No person whose business is the publication of classified telephone directories shall refuse to include and print in a paid directory display advertisement the certificate of competency number of a contractor where the applicant for the display advertisement provides the number to the person who publishes the telephone directory. This is a nonpenal provision of the Code. No liability shall attach to the person whose business it is to publish classified telephone directories for errors, failures, or omissions relating to the inclusion or printing of a certificate of competency number.
