§ 10-3. Assessment of additional court costs in criminal and juvenile cases.

  • (a)

    In accordance with the authority granted by Section 939.185, Florida Statutes, an additional court cost of sixty-five dollars ($65.00) shall be imposed by the court upon every person who pleads guilty or nolo contendere to, or is found guilty of or adjudicated delinquent for, any felony, misdemeanor, delinquent act, or criminal traffic offense under the laws of this state.

    (b)

    Funds received from this additional court cost shall be accounted for separately and distributed as follows:

    (1)

    Twenty-five percent (25%) shall be allocated to fund innovations to supplement state funding for the elements of the state court system identified in Section 29.004, Florida Statutes, in Broward County and county funding for local requirements under Section 29.008(2)(a)2, Florida Statutes.

    (2)

    Twenty-five percent (25%) shall be allocated to assist in providing legal aid programs in Broward County consistent with Section 29.008(3)(a), Florida Statutes.

    (3)

    Twenty-five percent (25%) shall be allocated to fund personnel and legal materials for the public as part of a law library in Broward County.

    (4)

    Twenty-five percent (25%) shall be used as determined by the Board of County Commissioners to support juvenile assessment centers and other juvenile alternative programs.

    (c)

    The court shall order the payment of these additional court costs in each applicable case, but may defer payment if the person against whom the cost is imposed is indigent.

    (d)

    Consistent with Section 939.185, Florida Statutes, the County Administrator, or the County Administrator's designee, must prepare a quarterly report identifying the amount of funds collected and providing an itemized list of expenditures for all authorized programs and activities funded pursuant to subsection (b). These quarterly reports shall be submitted to the Board of County Commissioners, the Governor, the Chief Financial Officer, the President of the Florida Senate, and the Speaker of the Florida House of Representatives.

    (e)

    At the end of each county fiscal year, any unspent funds collected pursuant to this section and allocated under paragraphs (b)(2), (b)(3), and (b)(4) shall be transferred for use to fund the activities authorized pursuant to paragraph (b)(1).
