§ 10-4. Surcharge for certain traffic-related infractions and violations.

  • (a)

    In accordance with the authority granted in Subsection 318.18(13), Florida Statutes, as amended from time to time, every person who pays a fine or civil penalty for any violation of a noncriminal traffic infraction pursuant to Chapter 318, Florida Statutes, as amended, and every person who pleads guilty or nolo contendere to, or is convicted of, regardless of adjudication, a noncriminal traffic infraction or a criminal traffic violation listed in Section 318.17, Florida Statutes, as amended, shall be assessed a surcharge of thirty dollars ($30.00). As used in this section, a "noncriminal traffic infraction" means an infraction designated in Subsection 318.14(1), Florida Statutes, as amended.

    (b)

    The Court shall order payment of this surcharge in all matters subject to the provisions of subsection (a), and the Clerk of Court shall add the surcharge to all payments of fines or civil penalties for any violation of a noncriminal traffic infraction. As provided in Subsection 318.18(13)(a)(1), Florida Statutes, as amended, this surcharge shall not be waived by the Court.

    (c)

    All funds collected pursuant to this section shall be used to fund state court facilities. All funds shall be appropriated and expended as directed by the Board of County Commissioners.
