§ 12-58. Interests in property.

  • (a)

    All right, title and interest in and to all property both real and personal; uncollected taxes; recorded and unrecorded liens; dues; claims; judgments; decrees; and choses in action, held or owned by the Broward County Fire Control District or the Broward County Fire Control Commission as created by Chapter 69-911, Laws of Florida, Special Acts of 1969, as amended, and continued by Broward County Ordinance No. 74-21, where said right, title, or interest was acquired as a result of the levy or expenditure of assessment or other county funds are hereby transferred to and vested in Broward County, Florida.

    (b)

    All right, title and interest in and to all property both real and personal; uncollected taxes; recorded and unrecorded liens; dues; claims; judgments; decrees; and choses in action, held or owned by any subdistrict, division, or chartered department within the Broward County Fire Control District as created by Chapter 69-911, Laws of Florida, Special Acts of 1969, as amended, and continued by Broward County Ordinance No. 74-21, where said right, title or interest was acquired as a result of the levy or expenditure of assessment or other county funds are hereby transferred to and vested in Broward County, Florida.

    (c)

    In the event there shall be any doubt or conflict as to the county's right, title or interest in and to any of the property or other interests referred to in subsections (a) and (b) of this section, the burden of proving any adversary interest therein shall be upon the party or parties claiming such right, title or interest.
