§ 20-174. Notice and service of process.

  • Notice of hearings shall incorporate and set out the following:

    (a)

    The name of the complainant;

    (b)

    The alleged charge and approximate date or dates of the commission of the act(s);

    (c)

    The section of the code or law or regulation alleged to be involved;

    (d)

    Notification as to the time, date and place of the board hearing;

    (e)

    Notice to the respondent that the respondent may be represented by counsel, and that the respondent may bring all original documents and other data pertinent to the case; and

    (f)

    That such respondent will be given an opportunity to present witnesses and evidence such respondent may deem appropriate.

    (2)

    Notice shall be deemed sufficient if served in any one (1) or more of the following ways:

    (a)

    By personal service;

    (b)

    By publication in a newspaper of general circulation in Broward County, Florida, one (1) time; however, service by publication shall only be used when no business address can be readily ascertained for the respondent after diligent search and inquiry;

    (c)

    By posting in a conspicuous place at the respondent's place of business;

    (d)

    By prepaid mail, return receipt requested, addressed to the last-known business address of the respondent and deposited with the United States Postal Service.
