§ 26-82. Purpose and authority; transfer of leave, etc.; authority to require recertification.

  • (a)

    The purpose of the Civil Service Ordinance is to establish a civil service system of human resources administration to serve Broward County, Florida. The system herein established shall be consistent with the following merit principles:

    (1)

    Recruiting, selecting and advancing employees on the basis of their relative ability, knowledge and skills, including open competition of qualified applicants for initial appointment;

    (2)

    Establishing pay rates consistent with the principle of providing comparable pay for comparable work;

    (3)

    Training employees, as needed, to assure high quality performance;

    (4)

    Retaining employees on the basis of the adequacy of their performance, correcting inadequate performance and separating employees whose inadequate performance cannot be corrected;

    (5)

    Assuring fair treatment of applicants and employees in all aspects of human resources administration without regard to political affiliation, race, color, creed, national origin or ancestry, age, sex, sexual orientation, disability or religion, and with proper regard for their privacy and constitutional rights.

    (6)

    Assuring that employees are protected against coercion for partisan political purposes and are prohibited from using their official authority for the purpose of interfering with or affecting the result of an election or a nomination for office.

    (7)

    Establishing a procedure for the presentation and adjustment of employee grievances based on alleged inequitable treatment because of some conditions of their employment or based on alleged discrimination because of race, color, creed, national origin or ancestry, age, sex, disability or religion.

    (8)

    Providing reasonable flexibility for the conduct of county business in an efficient and cost-effective manner.

    (b)

    The Broward County board of county commissioners may by resolution of the board, passed by at least a five-sevenths majority vote of the full board, transfer to a Broward County civil service employee all or any portion of his or her accrued longevity, annual leave, sick leave and other benefits vested in said individual while employed by the State of Florida or any county, municipality, agency, division or department of the state; provided, however, that no benefits may be transferred until an employee has successfully completed his or her probationary period established by the Broward County Civil Service Rules and Regulations.

    (c)

    The Broward County board of county commissioners shall have the power and authority to require and provide for the examination and recertification of those classified civil service employees included within job classifications, which require as a condition of employment licensure by a Broward County licensing board and which, due to changing conditions, would indicate that a change in the qualifications and competency of such employees would be necessary to maintain community standards. The decision of the board of county commissioners shall be conclusive as to any determination of the need or necessity for examination and recertification, and the commission may make such provisions in the Broward County Civil Service Rules and Regulations as it may deem necessary to exercise the authority granted by this section.
