§ 26-83. Scope and application.

(a)

The classified civil service shall be a permanent service to which this article shall apply and shall include all employees serving in positions in Broward County, Florida, now existing or hereafter established, excluding the following:

(1)

The members of the board of county commissioners, other elected officials and persons appointed to fill vacancies in elected offices;

(2)

The county administrator, deputy county administrator, assistant(s) county administrator, and assistants to the county administrator;

(3)

Members of appointed or elected boards, councils or commissioners, judges and the county attorney, deputy county attorneys, chief trial counsel, assistants county attorney, and commission auditor;

(4)

Department, division and office directors;

(5)

One (1) private aid for each elected member of the board of county commissioners and county administrator's aide;

(6)

Persons employed to conduct a temporary or special inquiry, investigation, examination or project on behalf of the board of county commissioners, a committee thereof or the county administrator;

(7)

Volunteer personnel who receive no regular compensation from Broward County, Florida;

(8)

Temporary personnel;

(9)

Persons performing work under contract for Broward County who are not carried on the payroll as employees;

(10)

Employees not under the jurisdiction of the board of county commissioners of Broward County, Florida, and employees assigned to the legislative delegation;

(11)

One (1) full-time staff attorney for the Broward County Planning Council;

(12)

The special projects coordinator and secretary of the Broward County Historical Commission;

(13)

The staff auditors in the office of the commission auditor and the administrative assistant to the commission auditor;

(14)

Any classification or position specifically excluded by an action of the board of county commissioners of Broward County, Florida, prior to the enactment of this subsection [June 18, 1981], and any classification or position specifically excluded by resolution of the board of county commissioners of Broward County, Florida, subsequent to the enactment of this subsection.

(b)

Nothing herein shall be construed as precluding the filling of any excluded positions in the manner in which positions in the classified civil service are filled.
