§ 27-63. Suspension and revocation.

  • (a)

    Licenses shall be effective unless suspended, revoked, surrendered or expired.

    (b)

    The license may be revoked or suspended if it is found that the license holder or its agent:

    (1)

    Submitted false or inaccurate information in the application or operational reports.

    (2)

    Has violated this chapter or license conditions.

    (3)

    Has failed to submit operational reports or other information required by this chapter and license conditions.

    (4)

    Has refused lawful inspection or sampling as required by this chapter.

    (5)

    Has failed to pay a penalty or comply with all actions required by a settlement agreement, final order or judgment resulting from an enforcement action, including a citation, by EPGMD against the applicant.

    (6)

    Is a habitual violator.

    (7)

    Has failed to comply with this chapter, license conditions, state pollution control laws or regulations, and/or federal pollution control laws or regulations.

    (8)

    Has failed to pay required fees.

    (c)

    A suspension or revocation shall become effective as provided in this Chapter.
