EPGMD may require an applicant to submit proof of financial responsibility and may
require the applicant to post appropriate security to guarantee compliance with this
chapter. If the applicant cannot establish sufficient financial security, the license
application may be denied. Failure to pay a penalty owed to EPGMD may be proof of
inadequate financial responsibility. Sufficient financial security shall mean the
financial capability of the applicant or licensee to cure any environmental damage
caused by the applicant's or licensee's activity, to ensure that the project is constructed
in accordance with the plans submitted with the license application, and/or to ensure
that all required license activities, conditions, or other requirements necessary
for compliance with this chapter are properly performed and completed. Any security
must be approved by Broward County Risk Management Division. The form of the security
must meet the approval of the County Attorney's Office.
