§ 9-44. Removal of members; vacancies.

  • (a)

    The appointing authority may remove any board member appointed by it for misconduct, incompetency or neglect of duty on its own motion or upon recommendation of a majority of the respective board. Neglect of duty shall include, but not be limited to, a member's absence, without good and sufficient cause, from three (3) consecutive regular or special meetings of the board or four (4) regular or special meetings in one (1) calendar year.

    (b)

    Any member subject to removal by the appointing authority shall, upon written request, be granted a public hearing prior to removal.

    (c)

    A vacancy occurring during the unexpired term of a board member shall be filled by a member appointed by the appointing authority for the balance of the unexpired term. Vacancies in the membership of a board shall be filled as soon as possible by the appointing authority.
